This Notice is intended to meet the requirements of both 24 CFR 58.43 (Publication of Responsible Entity’s Finding of No Significant Impact) and 58.70 (Notice of Intent to Request Release of Funds) simultaneously.  Public comments should note to which regulatory section(s) their comments are addressed.

On or about at least one day after the end of the comment period the City of West Haven will authorize the West Haven Housing Authority (now doing business as Savin Rock Communities) to submit a request to HUD  for the release of funds under Section 18 of the Housing Act of 1937, as amended, to undertake a project known as John Prete Apartments placing 77 Section 8 project-based vouchers in the units with existing tenants in place of federal public housing subsidy.

The activities proposed comprise a project for which a Finding of No Significant Impact on the environment was made and is published simultaneously with this Notice.  An Environmental Assessment (EA) that documents the environmental determinations for this project is on file at West Haven Housing Authority 15 Glade St. and may be examined or copied weekdays between 9 A.M and 4 P.M.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the EA to the City of West Haven Corporation Counsel’s office, All comments must be received by March 15, 2023.

ENVIRONMENTAL CERTIFICATION

The City of West Haven certifies to HUD that Nancy R. Rossi in her capacity as Mayor of the City of West Haven consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the West Haven Housing Authority to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of fund and the City of West Haven’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of West Haven; (b) the City of West Haven has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD at 20 Church St. Hartford, CT 06103.  Potential objectors should contact the HUD Hartford Field Office to verify the actual last day of the objection period.
